MINUTES OF THE MEETING
January 3, 2012

The Plymouth Conservation Commission held its regularly scheduled meeting on Tuesday, January 3, 2012 at the Plymouth Town Hall, 11 Lincoln Street, Plymouth, MA 02360.  Present were Gerre Hooker, Vice-Chairman and Commissioners James Aimone, David Foster, John Scagliarini and Paul Withington.  The Conservation Planner, Elizabeth Sullivan and the secretary, Michelle Turner, were also present.

Evelyn Strawn and Brooke Monroe were absent.

7:30 P.M.       Public Hearing Begin

Continued from November 15, 2011                                Continuance has been requested.
7:30 PM Paul A. & Kathy-Anne Healy, 201 Manomet Avenue, Parcel ID No. 046-000H-011B-000. A Notice of Intent for the placement of 2-3 ton stone, cobble, sand and gravel in order to control erosion on a coastal bank.   Project also involves removal of section of wooden stairs and replacement of flat-set boulders on a coastal bank.
A letter was read from J. Randolph Parker  requesting a continuance for both Healy and 207 Manomet Avenue Realty Trust, hearings.
John Scagliarini motioned to continue to February 28, 2011 at 7:30 PM.  Approved unanimously.

7:30 PM 207 Manomet Avenue Realty Trust, Kathleen F. & Matthew J. Kenney, Trustees, 207 Manomet Avenue, Parcel ID No. 046-000H-011A-000. A Notice of Intent to continue the construction of a coastal stone revetment on a coastal bank
David Foster motioned to continue to February 28, 2011 at 7:30 PM.  Approved unanimously.

7:40 PM Kenneth Scott, 44 Fuller Farm Road, Parcel ID No. 088-000-019-002.  A Notice of Intent to construct an addition to the existing dwelling in the buffer zone of Great South Pond.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
Steve Kotowski of Webby Engineering represented the applicant and explained the project.
Small addition 10 x 12 is proposed 51 ft. back.   No trees will come down for the project and a
full foundation is proposed.
Discussion ensued over the edge of pond noted on the plan from 2008 and the consensus was that the Commission would like to see a current wetland line.  

Jaime Aimone motioned to approve the project with a condition for a revised plan to show the current wetland line.  The motion also included approval of a waiver request to allow the addition within the 35 to 50 ft. no-build buffer zone.
Approved unanimously.

7:45 PM East Bay Grille, Paul Barbato, 173 Water Street, Parcel ID No. 014A-000-017-000.  A Request for Determination of Applicability to construct an addition to the existing restaurant facility, a portion of which is located in the buffer zone to the top of the coastal bank.
Mark Casey of South Shore Survey represented the applicant and explained the project.
John Scagliarini motioned to approve the project with conditions.  Approved unanimously.

7:50 PM NSTAR Electric Company, Kevin McCune, existing NSTAR easement, ROW’s 280 & 180.  Parcel ID No. N/A.  A Notice of Intent to construct approximately 11.75 miles of new 345 kV electric transmission line and related ancillary improvements, within the buffer zone of wetland resources.
This project is also subject to review by Natural Heritage Endangered Species Program and MESA.
The following representatives were present:  Mike Howard of Epsilon Associates, Vern Oheim, Project Director, Kevin McCune, and Cheryl Blain of NSTAR and .Dennis Galvin and Sean Hale also of Epsilon Associates.

All work will occur within existing rights-of-way.  There are eighteen (18) miles of new line to the Bourne Switching Station and 12 miles of new line in Plymouth.  Most of the area is buffer zone.  Two locations for substation work, one in the State Forest and one on the Plymouth/Bourne line.  All 3 structures in Plymouth are in the buffer zone.  Some clearing within the riverfront and bordering vegetated wetland will occur.  The project is designed under the Limited Project standards.  A Power Point presentation handout was submitted and there was a page by page presentation by Mr. Oheim.

Mike Howard reviewed the wetland jurisdictional areas that required the commission’s attention.  2 new vernal pools will be certified.  
Transmission line – 3 structures located in the buffer zone in Plymouth (see sheet 12) #33 and #34 structures.
3 structures is located on sheet 34, #92.  The augured soil will be spread in the immediate area.  The areas to be cleared is required for the construction and for future maintenance of the power lines.  Typically logging will take place and conservation seed mix will be used if necessary.  Swamp mats will also be used where necessary.
Environmental inspector will be onsite.  

Miscellaneous information:  The stacked monopole is 120 to 125 ft. tall and the delta pole is approximately 15 ft. shorter.  Gerri Hooker asked if placement of the lines underground was discussed and Mr. Oheim said the cost was prohibitive.

Public Comment:  
Laurie Hall, Lot 15 on South Curlew Pond Road in the Myles Standish Forest.  Asked about access through the Forest concern with the dust factor and concern with use of the roads during the heavy traffic periods.  They are in discussion with DCR.  
Jaime Aimone motioned to approve the project with conditions.  Approved unanimously.

ACTION ITEMS:
92 John Alden Road, Parcel ID 044-006-420-000 – Request to add fencing and curbing.
Letter from Land Management read into the record.  Discussion ensued with work occurring
Paul Withington motioned to approve a field change as proposed with a condition that any necessary approvals be sought from the Priscilla Beach Association and submitted to the office.

236 Clark Road, Parcel ID 069-000-002-000
        Request for a JO to demolish the existing dwelling and construct a new dwelling.
        Note:   Existing and proposed structure is outside the buffer zone
No Limit of Work line shown.
Work is within a Priority Habitat
John motioned to issue a JO with a condition that a silt fence is installed at the 100 ft. buffer zone to indicate the limit of work.  Applicant will file with MESA.  Approved unanimously.

ORDERS OF CONDITIONS:
• Kenneth Scott, SE57- No DEP number has been issued at this time and a letter from NHESP has not been received.  
James Aimone motioned to approve the draft Order, as amended, including issuance of a DEP file number and any condition imposed by NHESP.  Approved unanimously.

• NSTAR, SE57-2577.  
James Aimone motioned to approve as amended.  Approved unanimously.
